By using the 38america.com website, our ELITE client portal, or any service of .38 International LLC (“.38 America”, “we”, “us”), you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use our services.
2. Our services
.38 America provides firearms and defensive-tactics training, private range access, memberships, and related events. Participation is subject to eligibility under federal, Texas and local law, our safety rules, and a signed waiver and release of liability.
3. Registrations, memberships and payments
Class registrations, range reservations and memberships are confirmed only when payment is received. Membership fees are billed on the schedule shown at signup. Refund, cancellation and rescheduling terms are stated on the registration page or membership agreement for each service.
4. Safety rules
All clients must follow the Four Rules of firearms safety and the instructions of .38 America staff and Range Safety Officers at all times. We may refuse service or remove any person who does not comply, without refund.
5. Intellectual property
All course materials, manuals, videos and branding are the property of .38 International LLC and may not be copied or distributed without written permission.
6. Limitation of liability
To the fullest extent permitted by law, .38 International LLC is not liable for any indirect, incidental or consequential damages arising from the use of our services or website. Nothing in these Terms limits liability that cannot be limited by law.
7. SMS Terms
By providing your mobile number and consenting verbally, on our registration form, or by texting us first, you agree to receive text messages (SMS/MMS) from .38 International LLC / .38 America at (430) 204-3808 about your class registrations and reminders, range reservations, membership account matters, and replies to your inquiries.
- Message frequency varies by your activity with us; typically a few messages per month.
- Message and data rates may apply. Check with your carrier for details.
- Opt out at any time by replying STOP to any message. You will receive a one-time confirmation that you have been unsubscribed. To rejoin, text START or ask our staff.

- Carriers are not liable for delayed or undelivered messages.
8. Governing law
These Terms are governed by the laws of the State of Texas. Any dispute will be resolved in the courts of Grayson County, Texas.

We may update these Terms from time to time. The effective date above shows the latest version. Continued use of our services after a change means you accept the updated Terms.
